OUR DUTY TO SAFEGUARD YOUR PROTECTED HEALTH INFORMATION

 

Sullivan County Regional Health Department’s workforce is required by a new federal law entitledHealth Insurance Portability and Accountability Act (HIPAA) to safeguard your Protected Health Information (PHI). PHI is individually identifiable information about your past, present, or future health or condition, the provision of health care to you, or payment for health care.  We are required to give you a notice of our privacy practices for the information that we collect and keep about you.

 

 

OUR PLEDGE REGARDING YOUR PROTECTED HEALTH INFORMATION

We understand that health information about you is personal, and we are committed to protecting this information. This Privacy Notice applies to all of your health information, including 1) records relating to your care at a health department clinic and/ or 2) health care records received by the Department of Health from another source.

 

We are required by law to: (1) keep your PHI confidential; (2) give you this Privacy Notice; and (3) follow the terms of the current Privacy Notice.

 

 

 

 

HOW WE MAY USE AND DISCLOSE YOUR PROTECTED HEALTH INFORMATION FOR TREATMENT, PAYMENT, AND OPERATIONS

 

The following categories describe different ways we may use and disclose your PHI:

 

Ø      For Treatment.  We may use or disclose your PHI to doctors, nurses, nutritionists, technicians, or other health department personnel who are involved in taking care of you.  We may disclose your PHI to people outside the health department who may be involved in your medical care such as prescriptions, lab work and x-rays.  We may make your medical information available electronically or may electronically transmit your medical information to a third party, in order to fulfill our obligations in providing healthcare services to you.

 

Ø      For Payment.  We may use or disclose your PHI to get payment or to pay for health services that you receive. For example, we may need to tell your health insurance about a treatment you need in order to obtain prior approval or to determine whether your insurance will pay for the treatment.

 

Ø      For Health Care Operations.  We may use or disclose your PHI for the Sullivan County Regional Health Department’s operations. This is necessary to manage the Department’s programs and activities.  For example, we may use PHI to review our services, programs, and/or the quality of care that we provide to you.

 

Ø      Appointment Reminders.  We may use your PHI to contact you as a reminder that you have an appointment for treatment or services.

 

HOW WE MAY USE OR DISCLOSE YOUR PROTECTED HEALTH INFORMATION WITHOUT YOUR PERMISSION

 

The law provides that we may use or disclose your PHI from our records (even after your death) without your permission in the following circumstances:

 

Ø      As Required By Law.  We will disclose medical information about you when required to do so by law, to investigate reports of abuse or neglect, and to report the incident to the appropriate law enforcement agency.

 

Ø      Health Oversight Activities.  We may disclose PHI to a health oversight agency for activities authorized by law.  These oversight activities may include audits, investigations, inspections, and licensure.  These activities are necessary for the state and federal government to monitor the health care delivery system in Tennessee.

 

Ø      Public Health Risks.  We may disclose PHI about you for public health activities.  These activities may include the reporting of births and deaths and the tracking, prevention, or control of certain diseases, injuries and disabilities.

 

 

Ø      Research.  In certain circumstances, and under supervision of an institutional review board, we may disclose PHI in order to assist medical research.

 

 

Ø      To Avert a Serious Threat to Health or Safety.  We may use or disclose your PHI if necessary to prevent a serious threat to you or the health and safety of the public or another person.  Any disclosure, however, would only be to someone able to help prevent the threat.

 

Ø      For Specific Government Functions. We may disclose PHI to law enforcement, to government benefit programs relating to eligibility and enrollment, and for the interest of national security.

 

YOUR RIGHTS REGARDING HEALTH INFORMATION ABOUT YOU

 

You have the following rights regarding medical information we maintain about you:

 

Ø        Right to Inspect and Copy.  In most cases, you have the right to look at or get copies of your records.  You must make the request in writing.  You may be charged a fee for the cost of copying your records.

 

Ø        Right to Amend.  If you feel that there is a mistake or missing information in our record of your PHI, you may ask us to correct or add to the record. Your request must be made in writing, and you must provide a reason that supports your request.  We may deny your request under certain circumstances.   Any denial will state the reasons for denial and explain your rights to have the request and denial, along with any statement in response you provide, appended to your PHI.

 

Ø        Right to Know What Health Information We Have Released.  You have the right to ask for a list of disclosures made of your PHI made on or after April 14, 2003 for purposes other than those listed in the Privacy Notice. You must request this list in writing and state the period of time the list should cover for a period of no longer than six (6) years. The first list you request within a twelve (12) month period will be free.

 

 

Ø        Right to Request Restrictions. You have the right to ask us to limit how your PHI is used or disclosed.  You must make the request in writing and tell us what information you want to limit and to whom the limits apply.  For example, you could ask that we not disclose to your spouse information about a blood test you received. We are not required to agree to your request.  If we agree, however, we will comply with your request unless the information is needed to provide you emergency treatment or the information can be disclosed without your authorization.

 

 

 

Ø        Right to Confidential Communications.  You have the right to ask that we communicate with you in a certain way or at a certain place.  For example, you may ask us to send information to your work address instead of your home address.  You must make your request in writing.  You will not have to explain the reason for your request.  We will honor all reasonable requests.

 

 

Ø        Right to Authorize Release of Information:

Other releases of your PHI can be made only if you request it and you can change your authorization at any time.

 

 

 

Ø        Right to a Paper Copy of This Notice.  You have the right to a paper copy of this notice at any time. At your first visit to Sullivan County Regional Health Department, you will receive a copy of this privacy notice. You may also obtain a copy of this notice at our Websites listed below. To obtain an additional paper copy of this notice, contact the Privacy Officer for Sullivan County Regional Health Department. The State Privacy Policy is available from the State’s information listed below. We reserve the right to change our privacy practices and this notice at anytime. We will post a copy of the current notice in all Sullivan County Regional Health Department offices and at the Sullivan County Regional Health Department website.

 

HOW TO GET MORE INFORMATION OR COMPLAIN ABOUT OUR PRIVACY PRACTICES

NUESTRO DEBER DE SALVAGUARDAR SU INFORMACIÓN MÉDICA PROTEGIDA

 

Una nueva ley federal titulada la Ley de Transferencia y Responsabilidad de los Seguros Médicos (HIPAA) exige que el personal del Departamento de Salud protección su Información Médica Privada (Protected Health Information, PHI). PHI es la información individual que le identifica sobre su salud o enfermedad pasada, presente o futura, la prestación de atención médica a usted o el pago por la atención médica. Se nos exige que le demos un aviso sobre nuestras normas de privacidad en cuanto a la información que recopilamos y conservamos sobre usted.

 

NUESTRA PROMESA EN CUANTO A SU

INFORMACIÓN MÉDICA PROTEGIDA

Entendemos que la información médica sobre usted es algo personal y nos comprometemos a proteger esta información. Este Aviso sobre la Privacidad se refiere a toda su información médica, incluyendo 1) los expedientes relacionados con su atención médica en una clínica del Departamento de Salud y/o 2) expedientes médicos que el Departamento de Salud reciba de alguna otra fuente.

 

La ley exige que: (1) mantengamos la confidencialidad de su PHI; (2) le demos este Aviso sobre la Privacidad; y (3) cumplamos con lo establecido en el Aviso sobre la Privacidad vigente.

 

 

 

 

CÓMO PODRÍAMOS USAR Y REVELAR SU

INFORMACIÓN MÉDICA PROTEGIDA PARA EL TRATAMIENTO, PAGO Y FUNCIONAMIENTO

 

Las siguientes categorías describen las diferentes maneras que podríamos usar y revelar su PHI:

 

Ø      Para Tratamiento . Podríamos usar y revelar su PHI a médicos, enfermero(a)s, nutricionistas, técnico(a)s, u otros trabajadores del Departamento de Salud que se ocupan de prestarle atención.  Podríamos revelar su PHI a otras personas que no son parte del Departamento de Salud que puede que se ocupen de su atención médica tales como, medicamentos por receta, análisis de laboratorio y radiografías.  Podemos hacer su información médica disponible electrónicamente o podemos transmitir su información a una tercera persona, esto es parte de nuestra obligación para proveerle a usted  servicios de salud.

 

Ø      Para pagos . Podríamos usar y revelar su PHI para obtener pagos o para pagar por los servicios médicos que usted recibe. Por ejemplo, puede que necesitemos informarle a su seguro médico sobre un tratamiento que usted necesita para poder obtener autorización previa o para determinar si su seguro médico va a estar dispuesto a pagar por este tratamiento.

 

Ø      Para el funcionamiento de la asistencia médica .  Podríamos usar y revelar su PHI en el funcionamiento del Departamento de Salud. Esto es necesario para el manejo de los programas y actividades del Departamento. Por ejemplo, podríamos usar su PHI para analizar nuestros servicios, programas, y/o la calidad de la atención prestada.

 

Ø      Para recordarle de una cita . Podríamos usar su PHI para contactarle y recordarle que tiene una cita para recibir tratamiento o servicios.

 

CÓMO PODRÍAMOS USAR Y REVELAR SU INFORMACIÓN MÉDICA PROTEGIDA SIN SU PERMISO

 

La ley estipula que podríamos usar y revelar su PHI  que tenemos en nuestros archivos (incluso hasta después de su muerte), sin su permiso, en las siguientes circunstancias:

 

Ø      Conforme con la ley . Revelaremos información médica sobre usted cuando la ley lo exija, para investigar informes de maltrato o negligencia, y para informar a la agencia correspondiente encargada del cumplimiento de la ley de tal incidente.

 

Ø      Actividades de supervisión de la salud .  Podríamos revelar su PHI a las agencias de supervisión de la salud para actividades que la ley autoriza. Estas actividades de supervisión podrían incluir auditorías, investigaciones, inspecciones y concesión de licencias. Estas actividades son necesarias para que el gobierno estatal y federal supervise el sistema de prestación de atención médica en Tennessee.

 

Ø      Riesgos de salud pública . Podríamos revelar  PHI sobre usted en actividades de la salud pública.  Estas actividades pueden incluir el informar nacimientos y muertes y el seguimiento, prevención y control de algunas enfermedades, lesiones e incapacidades.

 

Ø      Investigación . En algunas circunstancias podríamos revelar su PHI, supervisados por una junta de supervisión de una entidad, para ayudar en una investigación médica.

 

Ø      Para evitar una amenaza grave a la salud o a la seguridad . Podríamos usar y revelar su PHI si fuera necesario para prevenir una amenaza grave a usted o a la salud y la seguridad del público u otra persona. Sin embargo, tal revelación sería sólo a alguien capaz de ayudar a prevenir tal amenaza.

 

Ø      Para funciones específicas del gobierno.  Podríamos revelar su PHI a agencias del cumplimiento de la ley, a programas de prestación del gobierno relacionados con la elegibilidad y la inscripción y en asuntos de la seguridad nacional.

 

SUS DERECHOS CON RESPECTO A LA INFORMACIÓN MÉDICA SOBRE USTED

 

Usted tiene los siguientes derechos con respecto a la información médica que mantenemos sobre usted:

 

Ø        El derecho a revisar y copiar . En la mayoría de los casos, usted tiene el derecho a revisar u obtener copias de sus expedientes. Debe hacer su solicitud por escrito. Puede que le cobren cierta suma por el costo de hacerle copias a sus expedientes.

 

Ø        El derecho a corregir . Si usted piensa que hay algún error o que falta alguna información en nuestro expediente de su PHI, puede pedirnos que hagamos correcciones o añadidura a su expediente. Tiene que presentar la solicitud por escrito, y tiene que exponer la razón que respalda su solicitud. En algunas circunstancias podríamos denegarle su solicitud. Toda denegación expondrá las razones por las que se denegó y explicará sus derechos a obtener la solicitud y la denegación, junto con cualquier declaración en respuesta que usted dé agregada a su PHI.

 

Ø        El derecho a saber qué información revelamos.  Usted tiene el derecho a solicitar una lista de las revelaciones que hemos hecho de su PHI durante y después del 14 de abril de 2003 con objetivos que no sean los expuestos en el Aviso sobre la Privacidad. Debe solicitar esta lista por escrito e indicar el período de tiempo que la lista debe abarcar y que no sea un período de más de seis (6) años. La primera lista que usted solicite dentro de un período de doce (12) meses es gratis.

 

Ø        El derecho a solicitar restricciones . Usted tiene el derecho a solicitar que limitemos la manera en que usamos y revelamos su PHI. Usted tiene que hacer esta solicitud por escrito y decirnos la información que quiere que limitemos y a quién se refieren estas limitaciones. Por ejemplo, usted podría pedir que no revelemos información sobre un análisis de sangre que usted se hizo a su cónyuge. No estamos obligados a acceder a su solicitud. Sin embargo, si accedemos, nos acataremos a su solicitud a no ser que necesitemos la información para prestarle servicios de urgencias o la información se puede divulgar sin su autorización.

 

Ø        El derecho a la Confidencialidad de la  Comunicación . Usted tiene el derecho a que nos comuniquemos con usted en un lugar o manera específica. Por ejemplo, usted puede pedirnos que enviemos información a su dirección del trabajo en lugar de su dirección domiciliaria.  Debe hacer su solicitud por escrito. No tendrá que exponer la razón por la que hizo esta solicitud. Trataremos de complacer toda solicitud razonable.

 

Ø      El derecho a autorizar la divulgación de                   información:  Se puede divulgar su PHI de otra manera sólo si usted lo solicita y usted puede cambiar su autorización en cualquier momento.

 

Ø        El derecho a una copia por escrito de este aviso .  Usted tiene el derecho a que le demos una copia por escrito de este aviso en cualquier momento, incluso si usted estuvo de acuerdo en recibir este aviso electrónicamente. Usted puede obtener una copia de este aviso en la página del Internet que indicamos a continuación. Para obtener una copia por escrito de este aviso, póngase en contacto con el Oficial de Privacidad del Estado que indicamos a continuación.  Nos reservamos el derecho a cambiar nuestras normas de privacidad y este aviso en cualquier momento. Pondremos una copia de este aviso en todas nuestras oficinas y en el sitio del Internet del Departamento.

 

CÓMO OBTENER MÁS INFORMACIÓN O QUEJARSE SOBRE NUESTRAS NORMAS DE PRIVACIDAD
